1. Scope
Fund That is operated by 16647758 Canada Inc. This notice applies when a person visits fundthat.com, submits a U.S. commercial financing request, communicates with Fund That about that request, or provides information in connection with a business financing transaction.
Our U.S. commercial financing services are intended for business-purpose financing. Product availability, provider participation, and legal requirements may vary by state and transaction.
2. Information we collect
Depending on the interaction, we may collect:
- Identity and contact information: name, date of birth, title, email address, telephone number, residential address, and preferred contact method.
- Business information: legal and operating names, structure, ownership, industry, time in business, revenue, employee count, business address, website, and related profile information.
- Financing information: requested amount, financing type, use of proceeds, timing, equipment or asset information, vendor information, and supporting documentation.
- Financial and verification information: financial statements, bank information, debt information, tax or accounting records, identity-verification information, fraud-prevention information, and other underwriting materials where requested.
- Credit information: business credit information and, when separately authorized, consumer report information relating to an owner, guarantor, or other individual.
- Consent and transaction records: consent selections, consent text version, timestamps, submission references, communications, and application-status information.
- Website information: IP address, browser/device information, pages visited, referral data, cookies, and advertising-attribution identifiers.
3. How we use information
We may use information to receive and review financing requests; verify identity and business information; identify potentially relevant financing providers; prepare and submit application materials; communicate about an application; request supporting documents; facilitate underwriting and closing; detect fraud and security issues; administer agreements; maintain records; operate and improve our systems; and comply with applicable legal, regulatory, contractual, and accounting obligations.
4. How we share information
For an authorized financing request, we may share relevant information with prospective banks, credit unions, finance companies, lessors, commercial lenders, financing platforms, and other financing providers that may evaluate the request. We may also share information with service providers supporting identity verification, fraud prevention, credit reporting, banking verification, document processing, electronic signatures, hosting, communications, analytics, security, and other operational functions.
We do not treat an application as permission to send information indiscriminately. Information is shared in connection with the requested financing, the applicant’s authorization, provider requirements, and applicable law.
5. Consumer and business credit information
If an individual owner, guarantor, or other person authorizes a consumer report in connection with a business financing request, Fund That and prospective financing providers may obtain and use that report only for a lawful purpose associated with the authorized financing request. The application presents a separate written credit-report authorization before submission.
Business credit reports and other lawful business-credit information may also be obtained and used to evaluate the applicant business.
6. Application communications and marketing
When an applicant submits a financing request, Fund That and financing providers reviewing that request may communicate about the application using the contact information provided, subject to applicable law and the consent presented with the application.
Marketing email or SMS consent is separate from application processing. Marketing consent, if offered, is optional and is not required to submit a financing request.
8. Retention and security
We retain information for as long as reasonably necessary for the financing request, business relationship, legal and regulatory obligations, fraud prevention, dispute resolution, and recordkeeping. Retention periods may vary by data type and transaction.
We use administrative, technical, and physical safeguards designed to protect information under our control. No system or transmission method can be guaranteed to be completely secure.
9. U.S. privacy rights
Depending on where you live and the information involved, state law may provide rights to request access, correction, deletion, or information about certain disclosures or uses of personal information, and may provide rights to opt out of certain targeted advertising, sale, or sharing activities. These rights are subject to applicable exemptions, including exemptions that may apply to business-to-business or financial information.
We may need to verify identity before completing a privacy request. We will evaluate requests under the law applicable to the requester and the information involved.
10. Minors
Fund That’s commercial financing services are intended for businesses and adults authorized to act for those businesses. The service is not directed to children.
11. Changes to this notice
We may update this notice as our U.S. services, providers, technology, and legal requirements change. The effective date displayed on this page identifies the posted version.
